Notice to Owners of Copyrighted Works.

If you hold a copyright or have been authorized to act on behalf of a copyright owner, or have been granted the right to act under any exclusive copyright protection, we kindly request that you report any alleged copyright infringements that are occurring on or through the RateX.co website. To do so, please complete the following “Notice” and submit it to the Designated Copyright Agent of RateX.co.

DMCA Notice of Alleged Infringement.

To ensure compliance with the Digital Millennium Copyright Act (DMCA), it is necessary to submit a DMCA Notice that clearly and accurately presents specific facts in a document signed under penalty of perjury, and delivered to RateX.co’s designated agent. To write a proper Notice, please provide the following information in accordance with the DMCA statute:

  • The provision of a physical or electronic signature by an authorized individual acting on behalf of the proprietor of the exclusive right purportedly violated.
  • The disclosure of the copyrighted material that is being contended to have been violated or, in the event that multiple copyrighted materials located on a single online site are implicated, an illustrative inventory of such materials present on that site shall be provided.
  • The Notice must furnish precise identification of the material that is being accused of infringement or is susceptible to infringing activity and is the subject of the request for removal or disabling. Additionally, the Notice should contain relevant particulars to assist the service provider in identifying the location of the material in question.
  • Contact information of the complaining party that includes an address, telephone number, and, if available, an electronic mail address, so that the service provider can reach out to them.
  • A statement in good faith that the complaining party believes that the use of the material in question is not authorized by the copyright owner, its agent or the law.
  • A statement confirming the accuracy of the information provided in the Notice, and a declaration under penalty of perjury that the complaining party is authorized to act on behalf of the owner of the exclusive right that has allegedly been infringed.

When submitting a claim of infringement, please ensure that you include any URLs that identify the material that you allege to be infringing. Additionally, any other relevant information that could aid the investigation of your claim by the designated agent at RateX.co should also be included.

If the material in question originates from a different website, and you believe that RateX.co has cached such material, then kindly provide confirmation of any of the following that apply:

  • The aforementioned material has been successfully expunged from its original source.
  • Additionally, all means of accessing the material from the originating site have been rendered inoperative.
  • Such measures were enforced pursuant to a judicial decree, which mandated the removal of the material from the originating site and/or restricted access to it.

It is imperative to note that failure to furnish all of the aforementioned information could result in a delay in the processing of the DMCA Notification. Furthermore, if it is determined that there was a material misrepresentation regarding copyright infringement, there could be legal consequences, including liability for damages, court costs, attorneys’ fees, and even criminal prosecution for perjury.

The completed Notice should be delivered to RateX’s Designated Copyright Agent:

Upon receipt of a valid claim, RateX.co will follow the procedures outlined in the DMCA, which prescribe a notice and take-down procedure. However, the user or webmaster may choose to submit a Counter-Notification claiming lawful use of the disabled works. Should RateX.co receive a valid DMCA Notification, the disputed material will be removed from public view, and the user or webmaster who posted the allegedly infringing material will be notified of its removal or restricted access.
